Stash It Forward Program Solicitation Agreement

This Promotion is offered by Stash Investments LLC (“Stash”). To qualify for the bonus, referred friends must open a Stash account within the time period specified in the Promotion. Please send invites only to people you know personally who will be glad to get them. Stash will send one invite and up to two reminders to each friend you invite: (1) in your name; and/or (2) with your name. The reminders may be different from the original invite and can be canceled by emailing support@stashinvest.com.

Your participation in the Stash it Forward program is subject to your agreement to the following terms:

Through the Stash it Forward program you may invite friends to sign-up for a Stash account by sending them an invitation via the Stash interface, and your efforts in soliciting clients to Stash will be limited to this activity.

This program intends for you to invite only your interested personal friends, family and known acquaintances to open a Stash account by utilizing the referral link and sharing tools we provide. Whenever and wherever you refer a friend under the Program, any additional statements you make, of which are not provided by Stash, about our investment advisory services, must be consistent with the content and materials we provide you and/or your friends and truthful, accurate, factually supported, not misleading. Any modification or efforts to bypass, manipulate, obscure or otherwise modify the delivery and accurate presentation of the referral link, sharing tools, content, disclosures or other materials and instructions we provide will be considered a violation of these terms.

You should not publish or distribute your referral links in locations where the audience is likely to include individuals you do not know or who may not be interested in Stash. To the extent you decide to post your referral link on any third party website or platform, such as a social media website, you must also comply with that third party’s terms of use. You should also be aware that by engaging in any such activity on a third party site (1) you will be, at your own risk, subjecting yourself to those third party sites’ privacy, security and consumer practices and policies which Stash does not endorse or control, and (2) that those third party sites may be able to tell, based on your activity, that you have a Stash account. You also acknowledge and accept that the friends you refer will be able to tell that you have a Stash account.

Subject to the terms and conditions specified in the promotion, for each “Qualifying New Account” Stash will deposit up to $10 of bonus funds into your Stash account, or waive the Wrap Fee applicable to your Stash account for a period of up to 12 months, or both. Stash may also deposit up to $10 of bonus funds into your referee friend’s Stash account, or waive the Wrap Fee applicable to your referee friend’s Stash account for a period of up to 12 months, or both, after your referee friend opens a “Qualified New Account” as defined herein. Under certain conditions, other fees including applicable Apex custodial fees and ancillary fees may apply. If you receive an associated fee waiver under any such fee waiver promotion, you will no longer be eligible for any future fee waivers under the same promotion. Even when you are not eligible to receive a fee waiver, you will be permitted to send invites to friends and they may be eligible to receive a 12 month fee waiver through the Stash it Forward Program, subject to the terms and conditions of the promotion. Furthermore, Stash may from time to time implement incentive programs of pre-specified duration in which you may earn additional compensation of up to $1,000 for referring multiple Qualifying New Accounts and/or you may be entered into a sweepstakes with a cash prize of up to a $20,000. The value of bonus funds may be taxable income to you. You are responsible for any federal or state taxes resulting from receipt of bonus funds. Please consult your tax advisor if you have questions about the tax treatment of bonus funds.

To participate in this bonus offer you must complete the account opening process for a Qualifying New Account. Bonus funds must remain in your Stash account for 90 days beginning from the date the bonus funds are deposited into your Stash account and for the entirety of the 90-day period. A “Qualifying New Account” is a new individual Stash account opened by your Stash referee friend using the special designated link from your invitation. Stash is not responsible for incorrect entry or other failure on the part of your referees to meet standards of a Qualifying New Account. Employer-sponsored taxable accounts provided through Stash For Business and tax-advantaged accounts (including Roth IRAs and Traditional IRAs) provided through Stash Retire are not Qualifying New Accounts. You cannot earn bonus funds for referring individuals who already currently have a Stash account or for individuals who have been referred by someone else. If two or more individuals invite the same individual to open Qualifying New Account, Stash will credit the bonus funds to the person whose referral link was used to complete the signup process.

Your Advisory Agreement with Stash governs our investment advisory relationship with you and these terms and conditions here do not in any way amend, supersede, change or replace your Advisory Agreement. This promotion is not valid with any other offers and is non-transferrable. Offer available to U.S. Residents only. Any controversy or claim arising out of or relating to these terms and agreements, or the breach thereof, shall be settled and subject to final and binding arbitration administered by the American Arbitration Association pursuant to its rules then in effect, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Arbitration must be commenced by service of a written demand for arbitration or a written notice of intention to arbitrate upon the other party. Any such arbitration shall be held in the city and state where Stash’s principal office is located at the time such arbitration is commenced. The parties agree that there shall be no right or authority for any claims to be arbitrated on a class action basis, and you expressly waive any right to bring a class action lawsuit or arbitration against Stash.

Stash reserves the right to terminate this offer at any time, to limit the amount of account bonuses you are eligible to receive, and to refuse or recover any promotion award if Stash determines that it was obtained under wrongful or fraudulent circumstances, that inaccurate or incomplete information was provided in opening the account, or that any terms of the Advisory Agreement have been violated. Stash reserves the right to suspend, cancel, terminate or modify this program and/or these terms and conditions at any time in its sole discretion. You are deemed to be aware of and bound by such changes by your continued access to or participation in the program. We will indicate that changes have been made by presenting these terms and conditions at the time of your making a referral anytime after an update to these terms and conditions. If you do not accept any such changes, your sole and exclusive remedy is to cease participation in the program.

In referring friends to open a Stash account you are acting on behalf of Stash and under the supervision and control of Stash and hereby agree to perform duties under these terms and agreements in a manner consistent with the instructions of Stash. You agree to limit the information you provide in connection with the referral to the referral web page and content provided by Stash. You agree that your participation in the Stash it Forward program will conform to the terms contained herein as well as the provisions of the Investment Advisers Act of 1940, 15 U.S.C. § 80b-1, and the rules thereunder.

You hereby represent that: (1) you are not subject to any statutory disqualification set forth in Sections 203(e) and 203(f) of the Investment Advisers Act (or any amended or replacement regulatory provision(s)); (2) you are not currently the subject of any investigation or proceeding which could result in statutory disqualification; and (3) you do not have a “place of business” at which you regularly provide investment advisory services, solicit, meet with, or otherwise communicate with clients, or any other location that is held out to the general public as a location at which you provide investment advisory services, solicit, meet with, or otherwise communicate with clients in any U.S. state. If you cannot accurately make the preceding representations, you may not participate in the Stash it Forward program. If you are currently participating in the Stash it Forward program and the preceding representations become inaccurate, you agree to immediately inform Stash at support@stashinvest.com.

 

 

 

 

 

The Stash It Forward Program (the “Program”) is a promotional referral program offered by Stash Investments LLC (“Stash”) where existing Stash customers may be rewarded for referring their friends to Stash subject to the terms and conditions stated herein (the “Program Terms”). To qualify for the cash bonuses described below, referred friends must open a Stash invest personal brokerage account and a Stash debit account in accordance with these Program Terms. By choosing to participate in the Program, you are accepting and agreeing to these Program Terms. These Program Terms form an agreement between you and Stash with respect to the Program. You should read these Program Terms carefully.

Eligibility

To be eligible to participate in this Program you must satisfy the following requirements: (i) you must have an individual taxable brokerage account advised by Stash (a “Stash Invest Account”), (ii) your Stash Invest Account must be in good standing, (iii) your referee friend must complete the account opening process for a Qualifying New Invest Account and/or a Qualifying New Debit Account, and (iv) your referee friend’s account(s) must be in good standing.

A “Qualifying New Invest Account” is a new individual taxable brokerage account advised by Stash opened by your referee friend using the special designated referral link from your invitation.

A “Qualifying New Debit Account” is a new Stash debit account provided by Green Dot Bank, Member FDIC, opened by your referee friend using the special designated referral link from your invitation, and where your referee friend has successfully set up one or more direct deposits posted from your referee friend’s paycheck(s) to their new Stash debit account within ninety (90) days from the date your referee friend opened the new Stash Debit account. 

Stash and/or Green Dot Bank reserve the right to determine in our/its sole or joint discretion whether an account is closed and/or in good standing. An account in good standing for purposes of this Program is an account for which all required opening documentation has been completed and verified, and is not locked, or restricted, or otherwise flagged in any way. If either account is closed or not in good standing for any reason at any time, any cash bonuses will be forfeited.

Cash Bonuses

Subject to these Program Terms, Stash will pay cash bonuses as follows:

1. For each Qualifying New Invest Account opened by one of your referee friends, Stash will deposit $5 of bonus funds into your Stash Invest Account and $5 of bonus funds into your referee friend’s Qualifying New Invest Account.
2. For each Qualifying New Debit Account opened by one of your referee friends, Stash will deposit $20 of bonus funds into your Stash Invest Account and $20 of bonus funds into your referee friend’s Qualifying New Invest Account.

The maximum amount of cash bonuses that you may be rewarded under the Program is $500 per calendar year. Any cash bonus deposited by Stash hereunder is a fixed cash value and does not constitute stock or any other security, nor is it a recommendation to buy any specific stock or other security. The value of any cash bonus awarded hereunder may be taxable income to you. You are responsible for any federal or state taxes resulting from receipt of bonus funds. Please consult your tax advisor if you have questions about the tax treatment of bonus funds. Bonus funds must remain in your Stash Invest Account for ninety (90) days beginning from the date the bonus funds are deposited in such account and for the entirety of the 90-day period, which shall be determined by Stash in its sole discretion. 

Referral Invitations

By participating in the Program, you agree to only send referral invitations to people you know personally by utilizing the referral link and sharing tools provided by Stash. You may send one invite in your name to each friend you invite. You acknowledge and accept that the friends you refer will be able to tell that you have a Stash account. Unless explicitly approved and authorized in writing by Stash, you may not make any statements to the friends you refer about Stash’s investment advisory products or services, or about your experiences as a Stash customer. You also agree not to make any statements that are untruthful, factually inaccurate, or misleading. You hereby acknowledge that any modification or efforts to bypass, manipulate, obscure or otherwise modify the delivery and accurate presentation of the referral link, sharing tools, content, disclosures or other materials and instructions we provide will be considered a violation of these Program Terms and may render you ineligible to participate further in the Program.

You agree not to publish or distribute your referral link in locations where the audience is likely to include individuals you do not know or who may not be interested in Stash, such as third party websites or platforms, including social media platforms. Stash reserves the right to refuse to pay any cash bonuses to you if it determines that you have failed to comply with the preceding sentence.

In referring friends in accordance with these Program Terms you are acting on behalf of Stash and under the supervision and control of Stash and hereby agree to perform duties under these Program Terms in a manner consistent with the instructions of Stash. You agree to limit the information you provide in connection with the referral to the referral web page and content provided by Stash. You agree that your participation in the Program will conform to these Program Terms as well as the provisions of the Investment Advisers Act of 1940, 15 U.S.C. § 80b-1, and the rules thereunder.

Legal Representations

You hereby represent that: (1) you are not subject to any statutory disqualification set forth in Sections 203(e) and 203(f) of the Investment Advisers Act (or any amended or replacement regulatory provision(s)); (2) you are not currently the subject of any investigation or proceeding which could result in statutory disqualification; and (3) you do not have a “place of business” at which you regularly provide investment advisory services, solicit, meet with, or otherwise communicate with clients, or any other location that is held out to the general public as a location at which you provide investment advisory services, solicit, meet with, or otherwise communicate with clients in any U.S. state. If you cannot accurately make the preceding representations, you may not participate in the Program. If you are currently participating in the Program and the preceding representations become inaccurate, you agree to immediately inform Stash by contacting us at support@stashinvest.com.

Other Program Information

Stash is not responsible for incorrect entry or other failure on the part of your referee friends to meet the standards of a Qualifying New Invest Account or a Qualifying New Debit Account. You cannot earn bonus funds for referring individuals who already have a Qualifying New Invest Account or a Qualifying New Debit Account or for individuals who have been referred by someone else. If two or more individuals invite the same individual to open a Qualifying New Invest Account or a Qualifying New Debit Account, Stash will credit the bonus funds to the person whose special designated referral link was first used by the referee friend to complete the initial registration process through Stash.

Your Advisory Agreement with Stash governs our investment advisory relationship with you and these Program Terms do not in any way amend, supersede, change or replace your Advisory Agreement. Program available to U.S. residents only. If you violate these Program Terms in any way, Stash reserves the right in its sole discretion to remove you from the Program or deny any cash bonuses awarded hereunder. 

Stash reserves the right to limit the amount of cash bonuses you are eligible to receive, and to refuse or recover any cash bonuses if Stash determines that it was obtained under wrongful or fraudulent circumstances, or was awarded to you in error, or that inaccurate or incomplete information was provided in opening the account, or that any terms of the Advisory Agreement, Terms of Use, or these Program terms have been violated. Stash reserves the right to suspend, cancel, terminate or modify this Program and/or these Program Terms at any time at its sole discretion.
